The Scotiabank® VISA* “Win a Getaway to The Toronto International Film Festival” Contest (the “Contest”) Official Rules

  1. To Enter: There are two ways to enter:
    i) PURCHASE ENTRY:
    An eligible ScotiaGold Passport ® VISA* card, Scotia Momentum® VISA* card, Scotiabank Value® VISA* card, No-Fee Scotiabank Value™ VISA* card, ScotiaHockey™ VISA* card, SCENE®* VISA* card, No-Fee ScotiaGold® VISA* card, No-Fee Scotia Moneyback® VISA* card or L’earn® VISA* card.  (“Eligible Scotiabank VISA”) cardholder will automatically be entered for a chance to win every time that he/she makes a purchase with his/her Eligible Scotiabank VISA card between June 15, 2011 at 12:00:01 a.m. Eastern Time (ET) and July 31, 2011 at 11:59:59 p.m. ET (the “Contest Period”) that is posted to his/her account by August 8, 2011 (a “Qualifying Purchase”).  Cash advances, including Scotia® VISA* Cheques, balance transfers from other cards or loans, interest, and account payments, fees (including, without limitation, annual fees, NSF fees, over credit limit fees, etc.), service charges, automated teller machine (ATM) transactions and purchase returns shall not be considered to be Qualifying Purchases. Transactions made during the Contest Period, but not posted to the applicable Eligible Scotiabank VISA account by August 8, 2011 shall not be considered Qualifying Purchases. 
    The following are also excluded from being eligible for entry: a) purchases made by an unauthorized user; b) purchases made with Scotiabank VISA cards that are stolen, fraudulent, tampered with, or otherwise altered, c) purchases made using any Scotiabank VISA card that is not listed above as an Eligible Scotiabank VISA card; and d) purchase returns.  A listing of Eligible Scotiabank VISA cardholder purchases made during the Contest Period and posted to an Eligible Scotiabank VISA account will be determined by The Bank of Nova Scotia.
    ii) NO PURCHASE REQUIRED:
    To enter as an Eligible Scotiabank VISA cardholder without purchase or obligation, hand-print your name, address, city, province or territory, postal code, day and evening telephone numbers, and a 100-word or more handwritten essay on the “Value of having a Scotiabank VISA card”, and mail in a postage stamped envelope to: The Scotiabank VISA “Win a Getaway to The Toronto International Film Festival” Contest, 49 Ontario Street, Suite 301, Toronto, Ontario, M5A 2V1.  Scotiabank VISA cardholders must include the first 8 digits of their Scotiabank VISA account number for verification purposes.  No-purchase entries must be postmarked by the last day of the Contest Period and received by Scotiabank by August 8, 2011.  No mechanical reproductions permitted.  All entries become the property of Scotiabank and will not be returned.  Scotiabank reserves the right to cancel this promotion at any time without prior notification.

  2. Drawing: On August 12, 2011 at 11:00 a.m. ET in Toronto, Ontario, a random draw will be held to select ten (10) potential Grand Prize winners and ten (10) potential back-up winners.  Maximum of one (1) prize per Eligible Scotiabank VISA cardholder.

  3. Eligibility: To be eligible to win a prize, an entrant must: a) be a Canadian resident; b) be a cardholder of an Eligible Scotiabank VISA card issued by The Bank of Nova Scotia in Canada prior to June 15, 2011, whose card is open and in good standing at the time of verification; c) have reached the age of majority in the province or territory in which she/he resides as of June 15, 2011, and; d) not be an employee of, or living with an employee of, Scotiabank or its affiliates, Visa Canada Corporation, Scotiabank’s advertising or promotional agencies, or the independent contest judging organization.  Contest is void where prohibited or restricted by law.  The Contest is subject to all applicable federal, provincial, and local laws and regulations.

  4. The Prizes and Their Approximate Retail Values: Ten (10) Grand Prizes available to be won, each consisting of two (2) tickets to one (1) Visa Screening Room Film Festival screening, two (2) nights of hotel accommodations (double occupancy) at a hotel to be chosen by Scotiabank in its sole discretion, one (1) $250 gift card for a Toronto restaurant of Scotiabank’s choosing and two (2) round trip economy class airline tickets to Toronto, Ontario from the airport nearest to the winner’s residence.  Approximate retail value of the prize is $3,250 CAD based on a Vancouver departure example, although the actual retail value may vary depending on the point of departure (the “Grand Prize Package”). Travel will take place from September 16 to September 18, 2011.  Prize is not transferable.  No substitution of the prize is permitted except at the sole discretion of Scotiabank. Any portion of the prize not accepted by the winner will be forfeited.  Any additional costs, taxes, charges or other fees incurred in using any prize are the winner’s sole responsibility.

  5. Odds: The odds of winning a prize depend on the total number of eligible automatic entries and eligible non-purchase entries received during the Contest Period.

  6. Use of Information: By using an Eligible Scotiabank VISA card to make a Qualifying Purchase during the Contest Period, participants agree to being automatically entered into the Contest and if selected as a potential winner for the Contest, either automatically or by way of no-purchase entry, it will be necessary for the contest administrator to contact them to award the prize.  No permanent records of any such personal information attained through the Contest will be retained, except for the administration of this Contest as set out in Section 7 of these Official Contest Rules.  If participating Eligible Scotiabank VISA cardholders do not want to be automatically entered into the Contest, they must call 1-877-299-1676 prior to the end of the Contest Period on July 31, 2011 and their Qualifying Purchases will not be entered into this Contest.

  7. Winner Notification/Prize Awards: Selected entrants will be notified via courier or in person by the independent contest judging organization. In order to win a prize, a selected entrant must correctly answer, unaided, a time-limited, arithmetical skill-testing question and sign and return Scotiabank’s standard Declaration and Release Form within 14 days from the time the prize notification is postmarked as having been sent by the independent contest judging organization.  The arithmetical skill-testing question and the Declaration and Release Form will be included in the prize notification package from the independent contest judging organization.  Non-responding selected entrants will be notified by phone at the two primary telephone numbers (as indicated on their Eligible Scotiabank VISA account records maintained on Scotiabank’s system or as shown on their no-purchase entry) between the 10th and 13th days following the initial notification.  No messages will be left and the independent contest judging organization must speak directly to the selected entrant.  The prize will be forfeited and not awarded if the prize notification is returned as non-deliverable, if the Declaration and Release Form, including arithmetical skill-testing question, is not returned within 14 days from the time the prize notification package is postmarked as having been sent by the independent contest judging organization, or if the arithmetical skill-testing question is incorrectly answered.

  8. Additional Terms: By participating, entrants agree to a) these Official Contest Rules and the decisions of the independent contest judging organization and Scotiabank which shall be final in all respects; and b) release, discharge, indemnify and hold harmless Scotiabank, Visa Canada Corporation, each of their respective subsidiaries, affiliates, officers, directors, and employees, including Scotiabank’s promotional agencies and the independent contest judging organization, from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.  By accepting a prize, winners agree to Scotiabank’s and its designees’ use of their names, city, province or territory of residence and/or photograph for advertising and publicity purposes without compensation.

  9. Limitation of Liability: Scotiabank shall not be responsible for print or typographical errors in any Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due no-purchase entries; or for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction.  Scotiabank reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, to cancel or modify the Contest if fraud or technical failures compromise the integrity of the Contest as determined by Scotiabank in its sole discretion.

  10. Privacy Policy: By entering this Contest, you consent to Scotiabank, its promotional agencies, contest administrator, and the independent contest judging organization storing and using the personal information submitted through automatic entry and through no-purchase entry for the purpose of administering the Contest in accordance with these Official Contest rules and Scotiabank’s privacy policy at www.scotiabank.com/privacy.

  11. For Québec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
